Please read these Terms and Conditions ("Terms", "Agreement") carefully before using the Sprout: Microgreens Tracker mobile application (the "App") operated by Yaroslav Homziak ("us", "we", or "our").
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.
By using the App, you represent that you are at least 13 years of age. If you are under 13, you are not authorized to use the App.
The App is provided on a "freemium" basis. Basic features are available for free, while certain "Premium" features require a paid subscription.
We may offer a Premium subscription with a 3-day free trial. You will not be charged until the trial period expires. To avoid being charged, you must cancel the subscription at least 24 hours before the end of the trial period through your Apple ID settings.
All purchases are processed through the Apple App Store. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
All financial transactions are handled by Apple. If you wish to request a refund, you must do so directly through the Apple App Store, subject to Apple’s refund policies. We do not have the technical ability to process refunds directly.
The App may allow you to upload photos or track data regarding your plants ("User Content"). You retain all your ownership rights to your User Content. However, by uploading content to the App, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display that content solely for the purpose of providing the App’s functionality to you (and for sharing features, should you choose to use them in the future).
You are responsible for ensuring that you have the right to upload any photos and that they do not violate any third-party rights.
The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Yaroslav Homziak and its licensors. The App is protected by copyright and other laws of Ukraine and foreign countries.
The App provides information and tracking tools for educational and informational purposes only.
YOUR USE OF THE APP IS AT YOUR SOLE RISK. THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
In no event shall Yaroslav Homziak be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.
These Terms shall be governed and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by updating the "Last Updated" date at the top of these Terms. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
